Registration of residence of a European Union citizen

LEGAL BASIS:
• Act of 14 July 2006 on entering the territory of the Republic of Poland, stay and leaving this territory by citizens of the EU Member States and their family members (Dz. U. No. 144, item 1043, as amended)
• Ordinance of the Ministry of the Interior and Administration of 24 August 2006 on application forms and documents regarding the right of residence on the territory of the Republic of Poland of citizens of the EU Member States and their family members (Dz. U. No. 154, item 1105, as amended),

I. Documentation required:

List of documents required to register residence of a European Union citizen, in case they are an employee or self-employed on the territory of the Republic of Poland (art. 16, point 1 of Act 1):
An application for registration of residence, submitted on a form and drafted in Polish. The original of the filled application form and 3 copies of the filled application form should be submitted.
• A written statement of the employer, or of the entity authorised to entrust the European Union citizen with the performance of work, of their intention to entrust them with the performance of work, or a confirmation of the performance of work (in case of EU citizens not affected by the limitations of access to the labour market on the basis of international agreements).
• A work permit promise for the territory of the Republic of Poland in case of EU citizens to whom the limitations of access to the labour market on the basis of international agreements apply.
• An extract from the National Court Register, if separate regulations require such an entry to the Register, or a confirmation of entry to the register of business activity, or another proof that confirms that the European Union citizen is self-employed on the territory of the RP.

List of documents required to register residence of a European Union citizen in case they are included in the national health insurance scheme, or are entitled to health service provisions on the basis of the regulations on coordination within the meaning of the Act of 27 August 2004 regulations on health service provisions financed from public funds (Dz. U. No. 210, item 2135, as amended) and possesses financial means sufficient to support themselves and their family members on the territory of the RP, without the need to use social security provisions (art. 16, point 2 of Act 1):
An application for registration of residence, submitted on a form and drafted in Polish. The original of the filled application form and 3 copies of the filled application form should be submitted.
• A document confirming inclusion in health insurance or entitlement to use health service provisions on the basis of the regulations on coordination of social security systems.
• A proof confirming the possession of sufficient financial means to support themselves and their family members, so that they are not a weight for the social security system.

Proofs confirming the possession of these means include in particular:
• a credit card,
• a confirmation of possession of legal tenders in a bank or another financial institution, confirmed by a stamp and a signature of an authorised employee of the bank or the institution, issued no later than a month before the submission of the application for registration of residence.

List of documents required to register residence of a European Union citizen, who is studying or in professional training in the Republic of Poland and is included in the national health insurance scheme, or is entitled to health service provisions on the basis of the regulations on coordination within the meaning of the Act of 27 August 2004 regulations on health service provisions financed from public funds (Dz. U. No. 210, item 2135, as amended) and possesses financial means sufficient to support themselves and their family members on the territory of the RP, without the need to use social security provisions (art. 16, point 3 of Act 1):
An application for registration of residence, submitted on a form and drafted in Polish. The original of the filled application form and 3 copies of the filled application form should be submitted.
• A confirmation, issued by a public or private college or university, of acceptance on a degree course, or a professional training referral.
• A document confirming inclusion in health insurance or entitlement to use health service provisions on the basis of the regulations on coordination of social security systems.
• A written declaration of possession of sufficient financial means to support themselves and their family members, so that they are not a weight on the social security system, or a proof that confirms their possession.

Proofs confirming the possession of these means include in particular:
• a credit card,
• a confirmation of possession of legal tenders in a bank or another financial institution, confirmed by a stamp and a signature of an authorised employee of the bank or the institution, issued no later than a month before the submission of the application for registration of residence.

List of documents required to register the residence of a European Union citizen who is a spouse of a Polish citizen (art. 16, point 4 of Act 1)
An application for registration of residence, submitted on a form and drafted in Polish. The original of the filled application form and 3 copies of the filled application form should be submitted.
• A document confirming the marriage contracted with a Polish citizen (a copy of marriage certificate).

ATTENTION
On submission of the application for registration of residence, a valid travel document (passport) should be produced. Another valid document that confirms identity and citizenship may be produced.
Documents drafted in a foreign language attached to the application form should be submitted together with their translation into Polish, drafted by a sworn translator.

The case is handled immediately.

V. Appeal procedure
The applicant can appeal to the Head of the Office for Foreigners, within the statutory period of 14 days from the day of delivering the decision.

VI. Comments
An EU citizen may enter and stay on the territory of the RP for up to 3 months, on the basis of a valid travel document or another valid document that confirms his identity and citizenship.

A family member, who is not an EU citizen, may enter the territory of the RP on the basis of a valid travel document and a visa, in case it is required. During their stay on the territory of the RP that does not exceed 3 months, a family member who is not an EU citizen must possess a valid travel document.
An EU citizen may leave the territory of the RP on the basis of a valid travel document or another document that confirms his identity and citizenship.
A family member who is not an EU citizen may leave the RP on the basis of a valid travel document.

If their stay on the territory of the RP is longer 3 months, an EU citizen must register their stay, and a family member who is not an EU citizen must obtain a residence card of an EU citizen's family member.

The application for registration or for issue of residence card of an EU citizen's family member should be submitted to the voivode competent for the EU citizen's place of residence, personally, no later than on the first day following the period of 3 months, counted since the day of entry on the territory of the RP.

A person who:
• fails to comply with the duty of registration of residence on the territory of the RP,
• evades the obligation to possess or replace a residence card of an EU citizen's family member or a permanent residence card of an EU citizen's family member,
• contrary to their duty, does not return a residence card of an EU citizen's family member, a document confirming the right of permanent residence or a permanent residence card of an EU citizen's family member,
is subject to a fine.
