Registering the stay of a European Union citizen's family member staying with them on the territory of the Republic of Poland (stay of a duration over 3 months) - issue of a residence card.

LEGAL BASIS:

• Act of 14 July 2006 on entering the territory of the Republic of Poland, stay and leaving this territory by citizens of the EU member states and their family members (Dz. U. No. 144, item 1043, as amended)
• Ordinance of the Ministry of the Interior and Administration of 24 August 2006 on application forms and documents regarding the right of residence on the territory of the Republic of Poland of citizens of the EU Member States and their family members (Dz. U. No. 154, item 1105, as amended),

I. Documentation required:

List of documents required to obtain a residence card for a European Union citizen's family member staying with them on the territory of the Republic of Poland (stay of a duration over 3 months)
Application for issue or replacement of a residence card of an EU citizen's family member, submitted on a form and drafted in Polish. The original of the filled application form and 3 copies of the filled application form should be submitted.
• 5 recent photographs of the applicant: undamaged, coloured, good quality (good focus and sharp) standard passport type photographs: sized 4.5 x 3.5 cm, taken within the 6 month preceding the application date, taken against a uniform plain light background, showing the applicant from the top of the head to the upper part of the shoulders, presenting clearly the applicant's face in a way that the face presents 70% to 80% of the picture; the face should be seen from the front and the person should look strait ahead with eyes open, not covered or hindered by hair, with a natural facial expression, mouth closed; the photograph should render the natural colour and hue of the skin and of the eyes, the eyes, especially the pupils, should be clearly visible, the line of the eyes parallel to the uuper side of the photograph.

Applicants with congenital or acquired vision defects may attach a photograph showing them wearing glasses with dark lenses. In such a case, the application must be accompanied by evidence of disability, or in its absence, the foreigner's statement of having a disability.
Applicants wearing a headdress in accordance with the principles of their religion may attach a photograph in the headdress, as long as the headdress does not cover or impede the full visibility the oval or of important parts of the face. In this case, the application must be accompanied by the foreigner's statement of belonging to a specified religious community.
• A document confirming the legal title to live temporarily in the dwelling.
• The proof of registration of stay of a European Union citizen, issued for the European Union citizen with whom the family member stays on the territory of the Republic of Poland.
Moreover:
• spouse - a document confirming the marriage contract,
• descendants (children, grandchildren) - a document confirming the existence of family ties and a document confirming age or dependence on the European Union citizen or their spouse,
• ascendants (parents, grandparents) - a document confirming the existence of family ties and a document confirming dependence on the European Union citizen or their spouse.
Attention!
On submission of the application for issue of a residence card for a European Union citizen's family member, a valid travel document (passport) should be produced.
Documents drafted in a foreign language attached to the application form should be submitted together with their translation into Polish, drafted by a sworn translator.

II. Payments
No fees

III. Time limit for handling a case
The residence card of an EU citizen's family member is issued no later than within the period of 6 months from the day of submitting the application for card issue.

V. Appeal procedure
The applicant can appeal to the Head of the Office for Foreigners, within the statutory period of 14 days from the day of delivering the decision.

VI. Comments
A family member who is not an EU citizen must possess a residence card for an EU citizen's family member that confirms their right of residence on the territory of the Republic of Poland and entitles, together with a valid travel document, to cross the border multiple times without a visa.
A residence card of an EU citizen's family member is valid for 5 years, and in case the intended period of stay on the territory of the RP of the EU citizen, whom the family member joins or with whom he stays, is shorter than 5 years - this document is valid for the period of the intended stay of the EU citizen.
